Lessons Learned from a 12-year-old’s Bike Crash

A bicycle accident in Costa Mesa left a boy hurt after a collision with a motor vehicle., The 12-year-old boy was riding westbound on Dallas Street when a car heading northbound on San Angelo Avenue struck him at around 3:45 p.m. Thursday. Paramedics took the boy to Sharp Grossmont Hospital for treatment of minor abrasions to his lower back and arms. He is said to be recovering this Friday afternoon. The motorist in the car was unhurt.
The Accident could have been Much Worse
Authorities indicate that the child was wearing a properly fitted bicycle helmet which mitigated his injuries. It is certain that the injuries would have been far worse if this was not the case.
In this incident, no criminal or civil charges had been brought against the driver who hit the boy.
Had the circumstances been different, and the boy had been seriously hurt, the parents may have been well within their rights to pursue the driver via a personal injury lawsuit.

But lets say that they boy was hit by the negligent driver and the helmet he was wearing, although properly fitted, failed to work as promised. The boy could have sustained serious head trauma which caused grievous permanent damage.
