Three-year-old Anthony Amaya was ejected from a car following a rollover accident that happened when the 2005 Chevy Malibu he was riding in flipped on the Colton freeway exchange. Police are still investigating the accident but it appears that the child was sitting in the rear seat when the car rolled over at around 8:18 p.m.
Investigators surmise that the accident occurred as the car was making the transition from the southbound lanes of I-215 to the westbound lanes of Interstate 10. Amaya died at 9:05 p.m. Sunday after succumbing to his injuries. He was pronounced dead at Loma University Medical Center.
Even seasoned investigators and medical personnel can hardly take the untimely passing of a child. When it is caused by something senseless, like a manufacturer’s defect, it can be especially troubling. Unfortunately, most rollover accidents are a result of faulty vehicle construction. If this is the case with little Amaya, his parents will be able to sue the car’s manufacturers for wrongful death via a product liability lawsuit.
